Ask Heidi – What Are Some Questions You Ask Clients?

There are many considerations that should be discussed with your attorney while putting together your Estate Plan. During our first meeting, I get the fundamental, expected questions out of the way, but I also ask some deeper questions, depending on the age and circumstances of the client. Here are some questions I ask my clients:

Have you considered all your important relationships?

If the parties are not legally married and no provisions have been made, your loved one could be displaced upon your death and not provided for as a spouse would, no matter how long your relationship was.    

Who is going to take care of your pets?

Our pets are often highly valued relationships and yet are treated as personal property upon the death of the owner.  This means that absent any specific provisions, they will be distributed to whoever wants them.  However, with proper estate planning, you can make sure your pet is taken care of after you pass.

What are your passwords, usernames, or security questions?

In the age of digital estate planning, it is so critical to ask the question of how to access your computers and online accounts.  Often when these questions are not addressed hardships can arise for family members who are seeking to determine the estate assets and manage financial accounts following the death of a loved one.
